What is a 'risk to the health and safety of others'?

This is the likelihood of someone else being harmed or injured (eg members of the public, employees, visitors, persons in proximity, etc) as a consequence of your work activity.

Most self-employed people will know if their work poses a risk to the health and safety of others. You must consider the work you are doing and judge for yourself if it creates a risk or not. If you're self-employed, health and safety law applies to you if:

  • you are an employer
  • your work activity is specifically mentioned in the regulations, this includes work in construction, agriculture, railways or work with gas, asbestos or genetically modified organisms
  • your work activity poses a risk to the health and safety of anyone else
  • Employers are required by law to protect their employees, and others, from harm. Under the Management of Health and Safety at Work Regulations 1999, the minimum you must do is:
  • identify what could cause injury or illness in your business (hazards)
  • decide how likely it is that someone could be harmed and how seriously (the risk)
  • take action to eliminate the hazard, or if this isn't possible, control the risk
  • How do I know if I create a risk to others?

You have a duty to protect yourself and others from the risks your work creates, even if this is only for a small part of your overall work activity. To do this you need to think about what might cause harm to people and decide whether you are taking reasonable steps to prevent that harm.(2) This is known as risk assessment and it is something you are required by law to carry out. If you have fewer than five employees you don't have to write anything down.(3) In practical terms, if you are self-employed you will not have to do anything where there is no risk to others.

A risk assessment is not about creating huge amounts of paperwork, but rather about identifying sensible measures to control the risks in your workplace. Your risk assessment will help you decide whether you have covered all you need to.

Safety certificates

If you use equipment that requires maintenance (eg PAT testing) or safety certificates (eg Gas Safety), then copies must also be provided.

Preparing a Risk Assessment

Professional traders should already have a risk assessment in place that covers attending events such as the Auckley Show. An electronic copy of that assessment together with copies of any safety certificates should be provided, in advance, to safety@auckleyshow.co.uk.

Small businesses and individuals should, if they already have an assessment, provide an electronic copy (photo, pdf, or word document) or make a statement on their application form (from Feb.’25) that they are exempt from written assessments. To simplify performing risk assessments for our event, Auckley Show provides a template to aid your completion of the task. If you use that template, please provide an electronic copy. The electronic copies should be sent to safety@auckleyshow.co.uk
